International AI access can mean downloading technology, operating an overseas deployment or calling a service that remains hosted elsewhere. Export-policy analysis becomes misleading when it treats those routes as interchangeable.

In its October 16 explanation, China’s Ministry of Commerce described a proposed catalogue expansion including 23 AI-related technologies. It separately stated that temporary pre-export registration would apply to technologies listed in the announcement while the catalogue revision is pending. The draft controls and that interim reporting layer should not be collapsed into a single claim that a final ban is already in force. MOFCOM explanation of technology-export catalogue revision.

The route of transfer changes the question

The ministry distinguishes overseas localisation of restricted model technology from providing API calls or web interactions. It also describes proposed facilitation for several activities and exclusion of relevant technology already in the public domain. These are statements of the ministry’s scope and intended treatment; an individual transaction still requires the announcement’s exact definitions and conditions.

For cross-border developers, the immediate task is to map what actually moves: weights, code, technical knowledge, control of an entity or only a service response. A customer’s experience may look similar while the underlying transfer and responsibilities differ.

Track the final catalogue

Our assessment is that this structure could influence where suppliers host and adapt systems, but the public explanation cannot establish how companies will reorganise. Watch the final catalogue, implementing guidance and documented licensing practice. Those will show which operating models remain straightforward and where cross-border collaboration acquires additional friction.
